1. Agreement
These Terms of Service (“Terms”) govern access to and use of Social Moderator AI (the “Service”). By creating an account, starting a trial, or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Social Moderator AI provides tools to connect Meta Pages, Instagram accounts and YouTube channels, define moderation rules in plain language, automatically moderate comments using AI, draft replies in your brand voice, and review actions in a shared workspace. Features and limits depend on your subscription plan. We may modify, suspend, or discontinue features with reasonable notice when practicable.
3. Accounts and eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for accurate registration information, safeguarding your credentials, and all activity under your account. Notify us promptly of unauthorized access.
4. Platform compliance
You must comply with Meta’s Terms of Service, Community Standards, and applicable Platform Terms for Facebook and Instagram. If you connect a YouTube channel, you agree to be bound by the YouTube Terms of Service, and our use of YouTube API Services is subject to the Google Privacy Policy. You grant us permission to access and process comment data only for Pages and accounts you own or are authorized to manage. You are solely responsible for your content, campaigns, and compliance with advertising and political content rules where applicable.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harassing, deceptive, or infringing purposes.
- Attempt to bypass security, rate limits, or access data of other customers.
- Reverse engineer the Service except where permitted by law.
- Upload malware or interfere with the integrity or performance of the Service.
- Use the Service to process personal data you do not have a lawful basis to share with us.
- Resell or sublicense the Service without our written consent.
We may suspend or terminate access for violations or risks to the Service or third parties.
6. AI moderation and human review
The Service uses automated systems to suggest or apply moderation actions based on rules you publish. AI outputs may be inaccurate or incomplete. You remain responsible for reviewing actions, overrides, and public-facing communications. We do not guarantee that all harmful content will be detected or that all legitimate comments will remain visible.
7. Subscriptions, trials, and billing
Paid plans are billed in advance through Stripe on a monthly or yearly cycle unless stated otherwise. Prices, limits, and features are described on our website and in your account. Taxes may apply. Trials convert to paid subscriptions unless cancelled before the trial ends. You authorize us and Stripe to charge your payment method for recurring fees.
You may cancel through the billing portal or by contacting support; cancellation takes effect at the end of the current billing period unless otherwise stated. Fees are non-refundable except where required by law or explicitly offered in writing.
8. Free trials and plan limits
Trial and plan limits (connected Pages, moderation volume, team seats, polling frequency, and feature access) are enforced automatically. Exceeding limits may require an upgrade or pause processing until you are within limits.
9. Intellectual property
We own the Service, software, branding, and documentation. You retain ownership of your rules, brand voice content, and underlying comment data. You grant us a limited license to host, process, and display your content solely to provide the Service.
10. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect it and use it only for the relationship, except for information that is public, independently developed, or rightfully received from a third party without restriction.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) EUR 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You will defend and indemnify us against third-party claims arising from your content, your use of the Service, your breach of these Terms, or your violation of Meta or other third-party policies, except to the extent caused by our gross negligence or willful misconduct.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your account for breach, non-payment, legal requirement, or prolonged inactivity with notice where reasonable. Upon termination, your right to access the Service ends; provisions that by nature should survive (payment obligations, disclaimers, limitations, indemnity) will survive.
15. Changes to these Terms
We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service and cancel any subscription.
16. Governing law and disputes
These Terms are governed by the laws of the European Union and the member state in which we are established, without regard to conflict-of-law rules. Courts in that member state have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring proceedings in your place of residence.
